- The Board of Water Works Trustees may hold a closed session under Section 388.9(1) and 622.10, Code of Iowa, to (1) discuss marketing and pricing strategies and proprietary information that may impact its competitive positon by public disclosure not required of potential or actual competitors related to ongoing negotiations over creating an integrated regional water authority; or (2) to discuss strategy with counsel in a matter currently in litigationand where the disclosure of strategy “would be likely to prejudice or disadvantage” the utility.
